Abstract

The digitalization of the Torrens system on the registration of dealings in Peninsular Malaysia has resulted to the beginning of electronic registration of land title in Malaysia. There are nearly forty piecemeal amendments to the National Land Code, made as and when the need emerge to address certain crucial issues in land administration; among of the examples, the introduction of the Fourteenth Schedule which commence the implementation of computerized land title registration system; also the insertion of the Sixteenth Schedule which contributes to the development and implementation the electronic land administration system. The ultimate outcome of the registration is to confer indefeasibility of title as an evidence to land ownership. However, many people have become victims of fraud. Due to the increase in fraud and the weaknesses of the registration system in the country, this study aims to provide solution to the problem. The objective of the study is mainly to analysed the evolution of the registration of land title in Malaysia beginning from its introduction to the Peninsular Malaysia until the implementation of electronic registration of land title; its role and effectiveness to overcome the controversy surrounding the indefeasibility as to compare with the traditional land registration system. In this research, the authors employ the method of textual analysis of legislation and case law, and consider the secondary data on existing works with regards to the implementation of the electronic land registration of title. The electronic land system and fraud prevention measures in the country that governs both paper and online based journalistic outputs also analysed.
