This chapter deals with the termination of contracts under the Malaysian Contracts Act 1950. It begins by looking at the provisions relating to termination for breach, then discusses the concepts of anticipatory breach and fundamental breach as well as the circumstances under which a breach will be considered sufficiently serious to entitle the non-breaching party to terminate the contract. It then turns to consider contractual termination clauses and their application. This is followed by a discussion of the procedure for terminating a contract and the circumstances under which the right to terminate will be lost. The final section deals with the effects of termination, including claims for restitution and compensatory damages. Various case hypotheticals are discussed throughout the chapter.
