Abstract

Children are subject to all forms of victimisation, and one of them is through exposure to harmful and illegal material online, particularly sexual material. Research has shown that paedophiles could make use of such materials to groom children into participating in pornography. It is the objectives of this research to examine the existing legislation in Malaysia relating to the prevention of children’s exposure to online sexual content and to recommend a legal framework requiring the implementation of age verification control mechanisms in Malaysia. The research methodologies in this study include traditional legal doctrinal analysis of various legislative frameworks enacted in Malaysia, as well as comparative jurisdiction of the Indian and English legislation on sexual related content. English legislation on age verification control mechanisms were also studied. Expert interviews were conducted to supplement the doctrinal research of this thesis. By introducing legal frameworks that would place certain responsibilities onto service providers, it is believed that it could significantly reduce the amount of sexual content online, thus preventing minors from being easily exposed to all types of sexual content from websites and social networking platforms.
